Semi Tractor Trailer Accident

National Truck Accident Lawyer and Attorney

In 2006, the Federal Motor Carrier Safety Administration (FMCSA) and the National Highway Traffic Safety Administration (NHTSA) released the results of a study investigating semi truck and tractor trailer accident causes. Large Truck Crash Causation Study (LTCCS) was the first-ever nationwide study of the problem, and it came up with some stunning conclusions. For example, the investigation found that over 50% of the accidents were caused partially or wholly by the big rig operator, or a failure of the semi truck itself.

What really made the investigation important is that it is one of the first studies to also look at what types of trucks are involved in accidents. For this study, investigators defined “truck” as any vehicle used for carrying items and weighing over 10,000 pounds.

By far the truck most represented in the study was the single tractor trailer configuration (the typical “big rig” semi truck), which accounted for 62% of the accidents in the study. The single unit truck with three or more axles was second at 14%. Although the tables do not explain why one type of truck is more involved in accidents than another, the general pattern was that the larger the truck in each category, the more accidents it was in. The only exception was the double-trailer configuration (5%), probably due to the overwhelming number of single trailer semi trucks.

Semi Truck and Tractor Trailer Accidents Have Complicating Factors

The comprehensive study compared data in many different ways including factors involved in the accident, what the vehicles involved in the accidents were doing just prior to the accident, where the accidents occurred (urban vs. rural, etc.), and the number of vehicles involved. But what it didn’t touch on, rightfully enough, was the legal aspect of these accidents. Who is to blame when a tire blows on a big rig while the driver is asleep at the wheel, under the influence of a prescription medication? The driver? The truck owner? The tire manufacturer?

When a logging truck spills its load across a busy highway, is the driver responsible? The company that loaded the logs? The tractor trailer company?

As you can see, semi truck and tractor trailer accidents can quickly become quite complicated. And while insurance companies and adjusters and corporate lawyers try to work out the mess, who is watching out for your rights?

If you or a loved one has been injured in a semi truck or tractor trailer accident, you should immediately look for legal representation. Insurance companies have been known to low-ball policy claims – sometimes refuse to pay them at all – even when the driver or the trucking company is clearly at fault.
